You Can Open or Conceal Carry

Florida Statute §790.25(3)(n) allows you to open or conceal carry a firearm, in your place of business/employment.  This was first recognized by the courts in Peoples v. State, 287 So.2d 63 (Fla 1973) and clarified to include the surrounding property in State v. Anton, 700 So 2d 743 (Fla. 2d DCA 1997).  However, be careful, as there is currently no case that informs us about common areas where a business is located such as a strip mall with a common parking lot.  Likely, based on the cases regarding condominiums and apartments, it is not permissible to carry in those common areas.

Also, it is important to remember that although you can legally open or conceal carry at your place of employment, your employer does not have to let you do so.  A business owner can prohibit the open or concealed carry of firearms on their property, with the exception of employee’s keeping a firearm securely encased in their vehicle.  To learn more about an employees right to carry in their vehicle visit our blog post on that topic at Firearm Firm Blog Post on Employees Right to Carry
